(1) I ACKNOWLEDGE, UNDERSTAND AND DECLARE THAT 

(a) To the best of my knowledge, I am in GOOD PHYSICAL CONDITION and have no disease or injury that would be aggravated by participating in activities related to the event/activity; 

(b) Participating or assisting others in participating in the event/activity may involve RISK OF INJURY TO ME, INCLUDING DEATH, LOSS OR DAMAGE TO ME OR MY PROPERTY, or other consequences, this might result not only from my own actions, inaction or negligence but also the actions, inaction or negligence of others, the rules play, or the conditions of the premises or of any equipment used; 

(c) There may be OTHER RISKS not known or not reasonably foreseeable; and understanding all of the above;

 

(2) I ASSUME ALL OF THE ABOVE RISKS AND RELEASE WAIVE, DISCHARGE, HOLD HARMLESS, INDEMNIFY AND COVENANT NOT TO SUE: 

(a) KVL (Khara Volleyball), committee members, volunteers, or officials affiliated with their programs; 

(b) Any affiliated subsidiary, organization, sponsors or related companies or businesses, other participants, municipalities, governmental agencies, agencies, sponsors, or advertisers, the respective administrators, officers, directors, agents, representatives, employees or volunteers of such entities or organizations; 

(c) Owners, lessors and lessees of premises used to conduct the event/activity FROM ANY AND ALL LIABILITY FOR INJURY, INCLUDING DEATH, LOSS OR DAMAGE TO PERSON OR PROPERTY, and OR ANY OTHER CONSEQUENCE in connection with entry in or arising out of participation in, performance in or lack of performance in, including travel en route to and for the event/activity; 

 

(3) I CONSENT TO 

(a) ALL EMERGENCY MEDICAL TREATMENT as may be deemed appropriate under existing circumstances by medical personnel or personnel associated with the event/activity; 

(b) Follow all rules and procedures of the event/activity and follow the reasonable instructions of the officers, directors, representatives, agents, and volunteers of KVL; 

 

(4) I provide consent to KVL, its Core members, volunteers or Agents, to PHOTOGRAPH, VIDEO or otherwise RECORD (“recordings activities”) participants and those who may observe activities, and may USE, PUBLISH, and BROADCAST such recordings in the KVL Website, Social Media (including but not limited to Facebook, YouTube, WhatsApp, Twitter, Instagram, etc.) for the purpose of promotion. I acknowledge and agree to KVL making such recordings and waive any rights or interest I may have to or in such recordings. 

 

(5) I agree that I am adequately informed of the risks of participating in group Activities and in the specific Activity I am now registering for and agree to take steps to assure that I am adequately informed of the conditions and risks for each Activity for which I may later register myself in which I choose to participate. For so long as the COVID-19 pandemic remains a threat, I agree to abide by any health screening measures implemented by KVL for daily participation. 

(a) I agree that KVL reserves the right to prohibit/prevent a participant from taking part in the event when their temperature scan runs over 100 F  

 

(6) I will abide by the general rules/policies governing the usage of the facility which includes, but is not limited to, The following shall be prohibited within the fenced areas of the facility: 

(a) All illegal drugs and other substances; 

(b) Weapons of all kinds except law enforcement officers in the execution of their duties and public demonstrations as approved by the Department Director or designee; 

(c) Animals of any kind except those serving the needs of the handicapped and those used in public demonstrations or programs as approved by the Department Director or designee; 

(d) Possession and consumption of liquor and alcoholic beverages;

(e) Any type of behavior that is detrimental to the normal operation of the facility or the safety of the public or employees; 

 

(7) Persons/groups using the facility shall be responsible for the breakage, loss, or damage to the facility and equipment and shall bear the full replacement cost for such breakage, loss, or damage 

 

(8) Persons or groups violating any of the general rules are subject to suspension from the facility and/or prosecution in the event of a law enforcement violation

I have read this waiver agreement in its entirety and have provided truthful information;

Proximity to infected individuals and other possible means of transmission like contact with surfaces, droplets and through the air present risks of infection with COVID-19 and other pathogens that can cause disease. 

KVL organization follows the advice of the CDC in preparing its facilities and Activities to help protect participants, staff, and the community and to help slow the spread of the COVID virus. The measures implemented may change from time to time as expert guidance develops and changes. The measures are adopted to help reduce the spread as KVL is not able to eliminate the possibility of spread, particularly due to reliance on participants and other individuals to practice social distancing and other measures. KVL relies heavily on the good faith efforts of participants and their families in following the screening and safety precautions implemented.
